Please read these Terms and Conditions carefully. By using Our Patch Education Pty Ltd (ABN: 50 640 869 209) Education and Care Programs, Before and After School Care, Holiday Care or Pupil Free Days (referred to as the “Program/s”) you agree to be bound by these Terms and Conditions.

If you do not understand, or do not accept, any or all of the terms or conditions, please contact us.

  1. I agree to enrol my Child/ren with Our Patch Education Pty Ltd to provide services and activities for my Child/ren. I declare that the information I have provided on the enrolment form is true and correct and I have completed the enrolment form to the best of my knowledge regarding all aspects of my Child/ren including any medical conditions and allergies.
  1. I agree to update my details and enrolment online if any of the information on my enrolment form changes in the future.
  1. I confirm that I have the lawful authority and capacity as the Child/ren’s legal Parent or Guardian to enrol my Child/ren with Our Patch Education Pty Ltd. I will immediately notify and provide a copy of any order a court makes for the custody and care of the Child/ren I have enrolled with Our Patch Education Pty Ltd.
  1. I agree that my child will be signed in/out (as the case may be) on the appropriate documentation or program tablet, by myself or an authorised person, on arrival and departure each day the child attends. I understand that a late pick up charge will apply when the child is collected after a Program’ advertised finishing time.
  1. I understand that if my Child/ren is not collected from the Program by the advertised closing time, I will be charged a late fee which is calculated per minute per Child and I agree to pay this additional cost.
  1. I acknowledge that I must notify Our Patch Education Pty Ltd if the child will be absent for any booked session for a Program. If a child does not arrive at a Program for which it is booked, the Program will follow set procedures and protocols including, where appropriate to contact the police after 30 minutes of a child not attending the Program. I acknowledge that cancellations must be made within the time frames outlined in my booking. I understand that full fees (less any applicable Child Care Subsidy) may apply for late cancellations and no-shows.
  1. I acknowledge that Our Patch Education Pty Ltd operates at the venue stated in the enrolment form and this form is also valid for any other Our Patch Education Pty Ltd program my Child/ren attend.
  1. I acknowledge that the child will not attend the Program/s if unwell, or suffering from a notifiable infectious or communicable disease as identified by the responsible health department in my State or Territory. If required by Our Patch Education, I will provide a health certificate confirming that the child is not suffering from an infection or communicable disease. I acknowledge that if I’m contacted by the Program to collect my sick child, I should come as soon as possible.
  1. I confirm that I have supplied Our Patch Education Pty Ltd all the details for any existing court or parenting orders, health or medical condition and/or medication for the child, specific dietary requirements and I will update that information immediately upon any change of these circumstances.I acknowledge that by not providing this information, including medication may result in care not being provided.
  1. I authorise Our Patch Education Pty Ltd Educators to obtain all necessary medical assistance and treatment for my child (including ambulance transportation) when needed and agree to pay the expenses for such medical assistance and treatment.
  1. We recommend that children with additional needs be booked into a Program/s more than two weeks in advance to ensure required Educator training, additional Educators or funding can be arranged. Children with additional needs not booked within the required notice period may not be able to use the nominated Program/s.I acknowledge that I will use all reasonable endeavours to provide at least two weeks’ notice of any additional needs associated with my booking. I acknowledge that bookings made within a shorter timeframe than this may not be able to be accommodated.
  1. I understand that Our Patch Education Pty Ltd may arrange excursions outside of the venue during the Holiday Care period. Details of all excursions, including the date, time, details of the excursion activity (and its address), estimated travel times and method of travel to the excursion will be advertised prior to the Holiday Care period. I agree that if I book my Child/ren into an excursion to be taken during the Holiday Care period and my booking is accepted:
  2. A) it will be at an additional cost and I agree to pay this cost
  3. B)I authorise and consent to my Child/ren being taken outside the venue to attend the excursion;
  4. C)I authorise and consent to Our Patch Education Pty Ltd transporting my Child/ren for the purposes of the excursion; and
  5. D)Due to our structuring and Educator requirements, I acknowledge that my Child/ren may not have a choice to remain at the venue instead of attending the excursion.
  1. I give permission and consent for my Child/ren to leave the venue where advised by the Educator/s or in the case of a medical emergency and emergency drills.
  1. I give permission for my Child/ren to be photographed for non- public displays ie- only within the program and venue which may include the school surroundings, school photo board, reflection journal, school newsletters and excursion locations. I can choose to ask that my Child is not photographed at all by placing a request in writing to the program coordinator.
  1. I understand that photographs/videos will not be used for biometric matching or identification. Our Patch Education Pty Ltd will not identify the child’s name (or other details) in its use of any photographs/videos at any time. I will notify Our Patch Education Pty Ltd if I do not authorise them to take suitable photographs/videos of the child.
  1. I give permission for my Child/ren to participate in the program based activities organised by Our Patch Education Pty Ltd for the days my Child/ren attend the Program.
  1. I give permission for the child to participate in all enrolled program activities, including, incursions and special events/clinics/offerings.
  1. I acknowledge that activities may include watching G rated videos/movies.
  1. I understand that my Child/ren will be under the direction and control of Educators, who will follow the Program(s) policies and procedures (including behaviour guidance procedures if required).
  1. I understand that if my Child continues to demonstrate unacceptable behaviour after behaviour guidance procedures have been followed, I will be notified by Educators and may be required to collect my Child/ren. I agree to immediately make arrangements to collect my Child/ren from the Program. I acknowledge that Our Patch Education Pty Ltd may cancel my Child/ren’s enrolment.
  1. I give permission for the Educator to consult with my Child/ren’s school regarding any behavioural or medical management issues in order to provide consistency and the best possible care of my Child/ren.
  1. I authorise Educators to apply sunscreen/insect repellent to my Child/ren when required, unless I have notified Our Patch Education Pty Ltd on the enrolment form that sunscreen/insect repellent is not to be applied.
  1. I acknowledge that my Child/ren may not be able to participate in outdoor activities unless I provide and they wear a hat. I will also ensure my child/ren will be dressed appropriately when participating in excursions.
  1. I take full responsibility for my Child/ren’s belongings while they are at the Program including on any excursion.
  1. I agree that as a Guardian or by adding an Emergency Contact I am making this person an authorised nominee who has been given permission to collect my Child/ren from the Program.
  1. I agree that as a Guardian or by adding an Emergency Contact I am making this person an authorised nominee who has been given permission to authorise consent to medical treatment, administration of medication, take my Child/ren out of the education and care Program.
  1. I agree and acknowledge that Our Patch Education Pty Ltd does not accept any liability for personal injury, property damage or loss sustained by any Child/ren due to them participating in a Program unless the injury, damage or loss was caused by the proven negligence of Our Patch Education, its directors or employees, or is otherwise required by law.
  1. I indemnify Our Patch Education Pty Ltd (including its directors, officers and employees) against any costs, expenses or liability incurred as a result of any damage or injury caused by my Child/ren to:
  2. A)property at the venue or an excursion location; and
  3. B)any other Child/ren and Educators at the Program.
  1. I agree to update and/or change my details and bookings via the online system using my user name and password when required, advised and at the beginning of each school year.
  1. I understand that I won’t be able to book my child into care if the Program/s has already reached its licensed capacity for that session.
  1. If my child requires on-the-day care, I understand that they will only be accepted into care if:
  • the licensed capacity has not been reached and there is availability.
  • the Educator to Child Ratio at the Program is met
  • my child is registered with Our Patch Education Pty Ltd; and
  • I have given written permission or any relevant documentation for my child to attend the Program/s.
  1. I acknowledge that it is my responsibility to provide Our Patch Education Pty Ltd and the Family Assistance Office with all relevant information to be eligible to claim the Child Care Subsidy.
  1. I agree and consent to Our Patch Education Pty Ltd direct debiting (my bank account or credit card) all fees that I may incur by using a Program on a fortnightly basis (including but not limited to Program fees, Holiday Program excursions, late fees, late payment fees, dishonour fees, late booking fees, merchant fees and cancellation fees). I undertake to keep my bank account and/or credit card details up to date at all times. I understand fees and charges are subject to change.
  1. I understand that if a session goes for longer than normal e.g last day of term, a pro rata fee will be charged.
  1. I understand that if non-payment of fees occurs my account may be suspended and bookings cancelled. I understand if non-payment of fees continues, the debt may be referred to a collection agency.
  1. I acknowledge that Our Patch Education Pty Ltd may amend and update its policies, regulations or terms and conditions from time to time and the amended document can be viewed in the Program on the iPad/Laptop or via a printed copy on request. I acknowledge that it is my responsibility to ensure that I am familiar with amended policies and procedures. I agree to comply with all amended policies and procedures.
  1. I acknowledge that Our Patch Education Pty Ltd is required to disclose information to the Department of Education and other government agencies. I understand that Our Patch Education Pty Ltd adheres to the Privacy Act 1988 and will ensure that information in my Child/ren’s enrolment record is not divulged to another person unless necessary for the care or education of my Child/ren, to manage medical treatment of my Child/ren, where expressly authorised by the Parent, prescribed in the Childrens’ Services Regulations 2009 (regulation 35(1) (d-e), if required by law or in accordance with the Privacy Act 1988. I acknowledge that I have read and accepted the Our Patch Education Pty Ltd full privacy policy which is available online or upon request.

I have read and agree to comply with:

  1. A) all operational policies and procedures which are available at each program
  2. B)the parent handbook and key information sheet
  3. C)the regulations provided to me with the enrolment; and
  4. D)all terms and conditions referred to above.
